General Terms and Conditions
§ 1 Scope
(1) These General Terms and Conditions apply to all services provided by Ayuasana, proprietor Naveen Reddy Ponakaladinne (hereinafter "Provider").
(2) Ayuasana offers wellness services. The sessions serve exclusively for well-being and relaxation. They do not replace medical treatment, diagnosis or therapy. No healing promises are made.
(3) Deviating terms of the guest are not recognised unless the Provider expressly agrees to their validity in writing.
§ 2 Conclusion of contract
(1) The presentation of services on the website does not constitute a binding offer but an invitation to submit an offer (invitatio ad offerendum).
(2) A booking can be made by email, phone, WhatsApp or via the booking form on the website. The booking request constitutes a binding offer by the guest.
(3) The contract is concluded when the Provider confirms the booking by email, WhatsApp or telephone.
§ 3 Services
(1) The Provider offers wellness treatments, in particular Abhyanga massage and yoga massage.
(2) The exact scope of services results from the respective service description on the website and the individual agreement.
(3) The Provider reserves the right to refuse or discontinue a treatment for good cause, in particular if there are health concerns.
§ 4 Prices
(1) The prices stated on the website at the time of booking apply.
(2) All prices are final prices. Due to the small business regulation pursuant to § 19 UStG (German VAT Act), no VAT is charged.
§ 5 Payment
(1) Payment is made in cash or by bank transfer.
(2) Cash payment is due immediately after the session. For bank transfer, payment is due within 7 days of invoicing.
§ 6 Cancellation and no-show
(1) Cancellations are free of charge up to 24 hours before the agreed appointment.
(2) For cancellations less than 24 hours before the appointment, 50% of the agreed price will be charged.
(3) In case of no-show without prior cancellation, 100% of the agreed price will be charged.
(4) The guest is free to prove that the Provider incurred no loss or a lesser loss.
§ 7 Obligations of the guest
(1) The guest agrees to provide truthful information in the booking form and registration form.
(2) The guest arrives at the appointment in a clean and hygienic condition.
(3) The guest informs the Provider before the start of the session about all health-relevant circumstances, in particular allergies, skin conditions, cardiovascular diseases, pregnancy and current medication.
§ 8 Contraindications and exclusion
(1) The Provider is entitled to refuse a treatment if contraindications exist, in particular: acute infectious diseases, fever, open wounds, acute inflammations, advanced pregnancy without medical clearance, and influence of alcohol or drugs.
(2) The guest bears responsibility for the accuracy of their information.
§ 9 Liability
(1) The Provider is liable for damages only in cases of intent or gross negligence, unless the damage involves injury to life, body or health.
(2) Liability for damages arising from concealed or inaccurate information provided by the guest in the registration form is excluded.
(3) The Provider expressly points out that the wellness treatments offered do not constitute healthcare within the meaning of the German Alternative Practitioners Act (HeilprG) and do not constitute medical treatment, and no healing effect is promised.
§ 10 House rules
The Provider exercises house authority on their premises. The instructions of the Provider must be followed. In case of violations, the Provider may ask the guest to leave the premises.
§ 11 Health notice and distinction from the practice of healthcare
(1) Ayuasana provides exclusively wellness and relaxation services. These do not constitute healthcare within the meaning of the German Alternative Practitioners Act (Heilpraktikergesetz, HeilprG). The Provider is neither a doctor nor a Heilpraktiker and does not carry out any medical or therapeutic activity.
(2) The treatments serve exclusively general well-being and relaxation. They do not constitute medical or therapeutic treatment, a diagnosis, nutritional counselling or any healing treatment. No illnesses, complaints or physical ailments are diagnosed, treated or alleviated, and no healing or health promises are made.
(3) Any individual tailoring of a treatment — for example based on personal preferences or the Ayurvedic constitutional profile (Vata, Pitta, Kapha) — is carried out solely for the purpose of making the wellness experience pleasant and comfortable. It is not a diagnostic procedure and does not constitute health or nutritional counselling.
(4) Responsibility for one's own state of health and fitness to participate lies solely with the guest. The guest confirms that, from their point of view, there are no health reasons against the booked wellness treatment.
(5) In the case of health complaints or illnesses, during pregnancy, and in case of any doubt about one's own suitability, the guest is strongly advised to seek medical advice on their own responsibility before booking. The treatment does not replace a visit to a doctor.
(6) Health-related information provided by the guest is collected exclusively for the purpose of carrying out the treatment safely and pleasantly, and to decide whether, as a precaution, a treatment should be declined. It does not serve to establish a diagnosis or a treatment plan. Details are governed by the Privacy Policy.
(7) The Provider is entitled to refuse or discontinue a treatment as a precaution. Beyond the service already rendered, this does not result in any disadvantage to the guest.
§ 12 Final provisions
(1) The laws of the Federal Republic of Germany apply.
(2) The place of jurisdiction for all disputes is, to the extent permitted by law, Cologne.
(3) Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
